Conform\u00e9ment \u00e0 la politique de l\u2019Ordre des th\u00e9rapeutes respiratoires de l\u2019Ontario, si le<\/span> registraire re\u00e7oit de l\u2019information selon laquelle la conduite ou les gestes d\u2019un membre <\/span>pourraient \u00eatre criminels, le registraire peut effectuer un signalement \u00e0 la police.<\/span><\/span><\/p>\n

2.0\u00a0\u00a0\u00a0\u00a0 BUT<\/strong><\/p>\n

Le but de la pr\u00e9sente politique est de permettre l\u2019ex\u00e9cution du mandat de l\u2019OTRO d\u2019agir dans <\/span>l\u2019int\u00e9r\u00eat du public.<\/span><\/span><\/p>\n

3.0\u00a0\u00a0\u00a0\u00a0 APPLICABILIT\u00c9<\/span><\/span>
<\/strong><\/p>\n

Il peut survenir des situations o\u00f9 l\u2019OTRO est mis au courant d\u2019information donnant au registraire<\/span> des motifs raisonnables et probables de croire qu\u2019un membre pourrait \u00eatre incomp\u00e9tent, frapp\u00e9 <\/span>d\u2019incapacit\u00e9 ou qu\u2019il pourrait avoir commis un acte de manquement professionnel. Si le<\/span> registraire est aussi d’avis que la conduite du membre pourrait \u00eatre criminelle, la pr\u00e9sente<\/span> politique pourra l\u2019orienter quant au processus de signalement \u00e0 la police.<\/span><\/span><\/p>\n

4.0\u00a0\u00a0\u00a0\u00a0 RESPONSABILIT\u00c9S<\/span><\/span>
<\/strong><\/p>\n

Si l\u2019OTRO signale une situation \u00e0 la police, l\u2019OTRO informe le membre que la police a \u00e9t\u00e9 avis\u00e9e, \u00e0<\/span> condition que cet avis ne nuise pas \u00e0 la situation, n\u2019entra\u00eene aucun risque et ni probl\u00e8me important.<\/span><\/span><\/p>\n

Si l\u2019OTRO effectue un signalement \u00e0 la police, il ne peut pas en aviser des parties tierces, en <\/span>raison des strictes dispositions touchant la confidentialit\u00e9 de la LPSR.<\/span><\/span><\/span><\/span><\/p>\n

Lors de la divulgation de renseignements au sujet d\u2019un membre, l\u2019OTRO se base sur le feuillet<\/span> d\u2019information sur la protection des renseignements personnels aux forces de l\u2019ordre publi\u00e9 par <\/span>le Commissaire \u00e0 l\u2019information et \u00e0 la protection de la vie priv\u00e9e.<\/span><\/span><\/p>\n

5.0\u00a0\u00a0\u00a0\u00a0 AUTORIT\u00c9 ET SURVEILLANCE<\/span><\/span>
<\/strong><\/p>\n

Le registraire communique l\u2019information \u00e0 la police, tel que pr\u00e9vu par l’article 36(1) de la<\/span> Loi sur <\/span><\/em>les professions de la sant\u00e9 r\u00e9glement\u00e9es de 1991 (LPSR)<\/em>.<\/span><\/span><\/p>\n

6.0\u00a0\u00a0\u00a0\u00a0 CONSID\u00c9RATIONS<\/span><\/span>
<\/strong><\/p>\n

Si la personne qui a communiqu\u00e9 l\u2019information indique qu\u2019elle n\u2019a pas signal\u00e9 la conduite ou les<\/span> actions du membre \u00e0 la police, le registraire peut effectuer un signalement \u00e0 la police, s\u2019il est <\/span>d’avis que :<\/span><\/span><\/p>\n

    \n
  1. la conduite ou les actions semblent \u00eatre de nature criminelle,<\/span><\/span><\/li>\n
  2. le non-signalement pourrait entra\u00eener d\u2019importants risques pour la population,<\/span><\/span><\/span><\/li>\n
  3. l\u2019OTRO est en possession de renseignements suppl\u00e9mentaires (comme les ant\u00e9c\u00e9dents <\/span>du membre aupr\u00e8s de l\u2019OTRO) qui pourraient raisonnablement sugg\u00e9rer que la conduite <\/span>repr\u00e9sente un mode de conduite habituel encore plus grave.<\/span><\/span><\/li>\n<\/ol>\n
